Colorado Springs Truck Accident Lawyers McCormick

The mighty interstate, I-25, runs right through the middle of Colorado Springs. This stretch of one of the countrys most important interstates for state-to-state commerce is packed with semi-trucks, and that means truck accidents occur regularly.

While trucking is a critical part of Americas transportation of goods between states, these monsters of the road also bring with them plenty of danger. Semi-trucks, or 18-wheelers are involved in some of the most serious and damaging traffic accidents in Colorado Springs.

For the rest of the cars on the road, trucks pose a significant threat, as the average car is simply outmatched by the shear size of the trucks when accidents occur. Significant injuries and fatalities are far more likely in accidents between a truck and a car than between two more-or-less evenly matched cars. For this reason, it is critical that you have a Colorado Springs Truck accident lawyerwho you can depend on, should you ever find yourself involved in an accident with a truck.

What to do following a Colorado Springs Truck Accident

Just like with any kind of traffic accident, everyone involved in a truck accident will find themselves in a state of shock, and possible panic, in the minutes following the crash. The single most important, and obvious, step that you need to take after a truck accident is to ensure your own imminent health and safety. Once you are out of harms way, it is critical to obtain medical attention, even if you have no outward signs of injury.

  • Record the details of the accident and the scene
    If you are able, take note of the conditions surrounding the accident such as the weather, road quality, lighting, and so on. Take pictures in order to document the scene as these can be invaluable when the settlement is taken to trial.

Commercial Truck Driving

Truckers must get required sleep as the Tracy Morgan case exemplifies.

A June 7, 2014, tragic trucking catastrophe on the New Jersey Turnpike exemplifies the all-to-common cause of many serious trucking collision: Lack of sleep. Reportedly, a speeding Wal-Mart tractor trailer crashed into the rear end of a limousine, killing one man and injuring comedian Tracy Morgan and three others. The truck driver had not slept for more than 24 hours, and had been on the clock for almost 14 hours, when the collision occurred. This is not a simple case of negligence. The needless death and injuries are an outrage.

This truck driver had been driving for 9 hours and 37 minutes straight. Certainly, he was under pressure to meet delivery expectations set by Wal-Mart. The retailer certainly knew beforehand that these kind of delivery schedules and expectations were bound to cause these kinds of collisions and horrible injuries.

The FMCSA Hours of Service rule for truck drivers contains an 11-hour daily driving limit and 14-hour work day limit. The new provisions that took effect in July 2013:

  • Limit the maximum average work week for truck drivers to 70 hours, a decrease from the previous maximum of 82 hours;
  • Allow truck drivers who reach the maximum 70 hours of driving within a week to resume if they rest for 34 consecutive hours, including at least two nights when their body clock demands sleep the most from 1-5 a.m., and;
  • Require truck drivers to take a 30-minute break during the first eight hours of a shift. While this new provision is a step in the right direction, many drivers still feel pressure from their employers to drive more than 60-70 hours a week with insufficient rest. Employers can try to push the responsibility on to their truckers.

These types of collisions happen on Colorado and interstate highways. The truckers, trucking companies, and hiring companies must be held accountable for the deaths and lifelong injuries they cause. Attorneys for injured motorists must be aggressively investigate whether inadequate sleep or employer delivery expectations was a cause of the collision.
