Because asbestos was used extensively by builders and manufacturers until the 1970s, workers in many occupations have suffered from exposure. In fact, asbestos was so widely used that virtually all occupations involving construction and manufacturing have been linked to asbestos exposure in one way or another. And because the latency period (the time between exposure and the appearance of the diseases symptoms) may be as long as 50 years, victims of asbestos exposure decades ago are only now experiencing the affects.

What is mesothelioma?

Mesothelioma is a rare form of cancer, caused by asbestos exposure, that begins in the mesothelium (the tissue that protects the lungs, stomach, heart, and other organs) and can quickly metastasize throughout the body.
According to the National Cancer Institute, approximately 2,000 new cases of mesothelioma are diagnosed each year. Approximately 8 million people nationwide have been exposed to asbestos in the workplace.

Frequently, mesothelioma develops in the cells lining the chest cavity (the pleura) or the abdomen (the peritoneum). Most people with malignant mesothelioma have worked at jobs where they inhaled asbestos. Others have been exposed to asbestos in a household or workplace environment, often without knowing it. Asbestos exposure that lasts as little as one or two months can result in mesothelioma developing 15 to 50 years later. People exposed decades ago are now being diagnosed with mesothelioma due to the diseases long latency period.

If you or a family member was exposed to asbestos and now suffers from mesothelioma or another asbestos-related disease, you have rights as a victim of a dangerous product. Contact the mesothelioma attorneys at NewYorkAsbestosLawyer.com. We help our clients establish liability and attain the financial compensation to which they and their families are entitled.

Mesothelioma Prognosis

In the fall of 2004, the Centers for Disease Control reported a surge in deaths related to asbestos exposure. Although asbestos use has dramatically decreased over the last several decades, asbestos-related deaths are rising. The CDC estimated that the mortality rate is expected to increase for at least another decade.

Mesothelioma is almost always fatal; the average survival rate for someone with malignant mesothelioma is 11 months. Race and gender do not factor into the development of malignant mesothelioma, as asbestos exposure is thought to be the most important risk factor. Mesothelioma has a peak incidence about 40 years after asbestos exposure, and it commonly develops when a person is between 50 and 70 years of age.

Mesothelioma Lawsuits

If you have been diagnosed with mesothelioma, or you have lost a loved one to an asbestos-related illness, you have the right to seek compensation from those responsible for your situation. While monetary compensation cannot alleviate your pain, it will ease the burden of financial concerns. We will help you hold the negligent parties liable for their actions.

Generally, there are two types of mesothelioma lawsuits: personal injury claims and wrongful death lawsuits. Mesothelioma victims may file a personal injury lawsuit to attain compensation for medical bills, lost income, and pain and suffering. In a wrongful death lawsuit, the survivor of a mesothelioma victim may file a claim for pain and suffering, funeral and burial expenses, and lost support and companionship.
