Time frame for claims

There is no time frame on medical negligence on a child although if they wish to pursue a claim by themselves and not by their parents or guardian then the must do so by their 21st Birthday in general circumstances although there is some exceptions to this rule.

For adults able to conduct their own affairs they must make their medical negligence claim in Scotland within 3 years of the incident or within 3 years of becoming aware that the medical treatment or advice they received caused them harm.
